§ 5.37 a. General Aggravated Felony Safe Havens

There are some aggravated felony safe havens which prevent a disposition from being considered an aggravated felony at all.  These are called “general aggravated felony safe havens.”  Their usefulness transcends safe havens that affect specific categories such as sexual abuse of a minor or crimes of violence.  Chapter 7 seeks first to identify aggravated felony safe havens that are generally applicable to all or many aggravated felonies.  See § § 7.2, et seq., infra.  Chapter 7 next discusses aggravated felony sentences, which form an indispensable requirement for a large number of very common aggravated felony offenses. See § § 7.18, et seq., infra.
