(C)  Other Safe Havens.  This ground of deportation does not apply if the noncitizen was not required to register. [1281]  If the person is in DHS custody, the DHS has the responsi­bility to notify the immigration court of this fact.[1282]  The DHS or Attorney General should be notified of the change of address on DHS form AR-il or EOIR-33 (if the noncitizen is in removal proceedings).

 


[1281] A noncitizen in the United States who (a) is 14 years or older, (b) has not been registered and fingerprinted under 8 U.S.C. § 1291(b) or the Alien Registration Act of 1940, § § 30-31 (repealed effective December 24, 1952, 66 Stat. 280), and (c) remains in the United States for 30 days or longer, must apply for registration and be fingerprinted prior to the expiration of the 30 days.  8 U.S.C. § 1302(a).
