(E)  Non-Substantive Offenses.  There appear to be a number of theft statutes that punish the offense of aiding and abetting a theft offense.  The Ninth Circuit, at least, has held that aiding and abetting a theft is not an aggravated felony.[759]  See § 3.50, supra.
