Throughout the opinion in Zamudio, the court spoke of procedures for resolving a “motion” to vacate a conviction for violation of Penal Code § 1016.5.  Not once did the court refer to any necessity for the defendant to proceed by way of a petition for a writ of coram nobis.  This should lay to rest the prosecution’s common argument that a “motion” is an improper means by which to raise a violation of Penal Code § 1016.5.
