The starting point in developing a strategy for minimizing adverse immigration consequences of a conviction is determining exactly what final result in the criminal courts is necessary to achieve the client’s objectives.  This is fundamentally a combined question of immigration and criminal law: What are the immigration effects of the various elements of the client’s criminal history, which effects can the client live with, and what changes in the criminal history can be achieved through criminal post-conviction relief?

 

            Close consultation is essential between someone experienced in the immigration consequences of criminal convictions and a criminal practitioner familiar with the various forms of obtaining post‑conviction relief.
