§ 5.17 E. Record-Clearance Under State Rehabilitative Statutes

For certain purposes, record-clearance procedures under state rehabilitative statutes sufficiently analogous to the Federal First Offender Act[15] will have important effects in eliminating or reducing certain adverse immigration consequences.[16]  These effects can be achieved by a petition for expungement of a criminal conviction under Penal Code § § 1203.4(a) (probation felonies and misdemeanors), 1203.4a(a)(nonprobation misdemeanors), 1210.1(d) (Prop. 36 cases), § 1203.45 (youthful offenders), Welf.& Inst. Code § § 1772, 1179 (same), Marijuana Arrest Record Destruction Under Health & Safety Code § 11361.5(b), and executive pardons.[17]
