§ 10.53 A. Mandatory Expungement Upon Early Termination

Penal Code § 1203.4(a) requires mandatory expungement be granted in cases in which the defendant has been discharged early from probation.  Even if the defendant has violated probation, if s/he has been discharged early from the probationary period, the conviction must be expunged.[202]  If probation is terminated early, the court has no discretion to deny relief under Penal Code § 1203.4.[203]
