If the probation department screens expungement applications for the court, call the probation department in advance to determine whether the client had a good relationship with the probation department and discover any problems ahead of time. The probation department may assign one officer to deal with expungements, or it may be possible to deal with the client's specific probation officer in order to discover the procedure followed in the particular county, obtain the proper forms, and submit them. If the probation department agrees to apply for the expungement on behalf of the client, counsel should follow up to make sure the expungement is granted.
