§ 9.42 12. Military and Selective Service Offenses

Adjudications by court-martial and related military tribunals may constitute “convictions,” within the meaning of the CMT deportation and inadmissibility statutes, if the procedure can be described as a criminal procedure.  Full courts-martial so qualify, according to the BIA, although the issue is not entirely free from doubt.  Summary procedures, however, may not qualify.  See § 2.11, supra.  This section concentrates on criminal offenses related to the selective service and the military which are prosecuted in civilian criminal courts, as would any other criminal offense.
